1. Introduction
These Terms and Conditions set forth the rules and regulations governing the use of the website www.tronik.ae (“Website”) and the purchase of our products and services. By accessing or using the Website, you agree to comply with these Terms. If you do not agree, you must not use this Website.
2. Eligibility
Our services are available only to individuals who are at least 18 years old and legally capable of entering into binding contracts. By using the Website, you confirm that you meet these criteria. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if eligibility criteria are not met.
3. Intellectual property
The products presented on our websites fall into the following categories: our own products and compatible spare parts.
3.1 Our own products:
These products are developed and manufactured by us, representing our exclusive intellectual property. All rights, including but not limited to copyrights, design, trademarks, and proprietary technology, are fully owned by us. Any unauthorized reproduction, duplication, or distribution of our products without prior written consent is strictly prohibited. Even if the permission is granted by us, the use of our images or videos without proper attribution is not permitted. Users must provide an appropriate reference to our company or include a direct link to our website when using such materials.
3.2 Third-Party Solutions and Fitting Spare Parts:
We sell original brake systems, their components, and compatible spare parts that have been lawfully acquired for commercial purposes. We do not claim ownership of the intellectual property associated with these third-party products. However, in accordance with the principle of exhaustion of intellectual property rights, we have the legal right to use, market, and resell these products once they have been placed on the market by the rights holder or with their consent. The sale of compatible spare parts is conducted in compliance with applicable laws, ensuring they are suitable for use with the intended products without infringing on third-party intellectual property rights.
The sale and use of third-party spare parts do not imply endorsement or affiliation with the original manufacturers unless explicitly stated.
4. Product Availability & Pricing
We strive to maintain accurate stock levels; however, product availability is not guaranteed at all times. All prices listed on our website are subject to change without prior notice due to market fluctuations, supplier adjustments, or other business considerations. In the event of a price adjustment after an order has been placed, we will inform the customer and provide options for order modification or cancellation.
5. Payment
We accept Visa, Mastercard, PayPal, and Stripe in EUR, USD, and AED. Payments are processed securely, and customers should be aware that additional fees related to currency conversion or international transactions may be applied by their financial institution.
6. Returns & Warranty
6.1 Legal Guarantee:
All products are covered by a minimum of a 2-year legal guarantee from the date of delivery, in compliance with UAE consumer protection regulations, ensuring they conform to the sales contract. Given the nature of the products, normal wear and tear is not covered under this guarantee. Any defects discovered within this period should be reported promptly with supporting evidence.
6.2 Warranty Policy:
(i) Conditions and Limitations
The warranty is valid only if the product has been used under normal conditions and maintained according to the manufacturer’s instructions. The warranty does not cover damages caused by improper use, unauthorized repairs, accidents, or modifications to the product. To ensure warranty eligibility, customers must adhere to the provided maintenance guidelines.
(ii) Warranty Claim Process
To make a warranty claim, the customer must contact us with the order number and a detailed description of the issue. We will provide instructions on how to return the defective product for inspection. If the product is deemed defective, it will be repaired or replaced at no additional cost, return shipping costs will be reimbursed. The customer must securely package the product to prevent further damage during transportation.
(iii) Exclusions
The warranty does not cover normal wear and tear, cosmetic damages, or damages resulting from misuse or neglect. Products that have been modified or repaired by unauthorized personnel are not covered under this warranty. Additionally, damages arising from environmental factors such as extreme temperatures, moisture, or chemical exposure are excluded.
6.3 Return Policy:
Returning the item to us is possible in the following cases:
(i) Defective Item in Damaged Packaging:
Upon receipt, the customer must inspect the packaging and report any visible damage to the Carrier on-site. The customer must inspect the packaging and report any visible damage to the Carrier on-site and notify us within 24 hours, providing photos and evidence of the damage. Based on this information, we have the right to file a claim with the Carrier. We will agree with the customer on the return terms and conditions, covering all return costs and issuing a full refund. The customer must ensure the item is packed securely to maintain its original condition during transportation.
(ii) Defective Item in Intact Packaging:
If the item inside undamaged packaging is found to be defective (e.g., scratches, chips, abrasions), the customer must notify us within 3 calendar days of receipt, providing photos and evidence of the defect. We will coordinate the return process, covering all costs and issuing a full refund. The customer must securely package the item to prevent damage during transit.
(iii) Incorrect Order or Incompatibility:
If the customer mistakenly orders an item or finds it incompatible, they may return it within 14 calendar days, provided it is unused and in its original condition. Returned items must include all original packaging and accessories and be unused. The customer is responsible for the return shipping costs and must securely package the item to avoid damage.
(iv) Incompatibility Due to Our Recommendation:
If the item is incompatible due to incorrect recommendations provided by us, the customer must notify us within 5 business days with supporting evidence. We will cover all return costs and issue a full refund. The customer must ensure secure packaging to maintain the item’s original condition during transit.
Returning the Item to us is not possible in the following cases:
- if the item was used for purposes other than its intended use;
- if the item has been used, is dirty, broken, scratched, or damaged;
- if the item is physically damaged and deemed unusable.
6.4 Refund Policy:
(i) Returns Process
Once the returned item is received, it will be inspected to ensure compliance with return conditions. If approved, the refund process will commence, and refunds may take up to 30 business days to be processed. If the return is not approved, the customer will be notified with reasons for the decision.
(ii) Refund Method
Refunds will be issued using the same payment method originally used for the purchase. The refunded amount will be credited back to the original payment source. Any additional processing time may depend on the policies of the customer’s payment provider.
(iii) Refund Conditions
Returned items must be in their original condition, unused, and include all original packaging, accessories, and documentation. Items that are damaged, used, or otherwise do not meet our return policy criteria will not be eligible for a refund. Customers will be responsible for any applicable return shipping costs unless the return is due to an error on our part or a defective product.
7. Delivery
Orders are shipped via reputable logistics providers such as FedEx, UPS, DHL, and DPD, as well as other reputable carriers. The cost of delivery of the order depends on its size and the desired date of receipt, according to the price list of the transport company. Shipping costs will be calculated and displayed during checkout. For oversized orders, delivery costs and terms will be determined on an individual basis. Our team will contact the Customer to provide detailed shipping options and associated costs. Estimated delivery times vary based on the destination and chosen shipping method. Delays may occur due to customs processing, weather conditions, or other unforeseen circumstances. The Customer will receive a tracking number to monitor the progress of the shipment.
All applicable duties, customs fees, and taxes are the responsibility of the Customer and must be settled in accordance with their local regulations. Failure to pay these fees may result in shipment delays or returns.
8. Limitation of Liability
We shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our products or services, including but not limited to loss of profits, data, or business opportunities. Our total liability, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Customer for the relevant order.
We are not responsible for delays, damages, or losses caused by third-party logistics providers once the order has been handed over to the carrier.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai.
